Amaury Sport Organisation (hereinafter referred to as “A.S.O.”) is a company that creates and organizes leading international sporting events.

The website available at the links https://www.aso-hospitalite.fr/ and https://www.aso-hospitality.com/ (hereinafter the “SITE”) is a commercial platform intended for companies, works councils, groups of employees (staff, volunteers, etc.) or associations, allowing them to purchase race bibs and access hospitality areas for certain events organized by A.S.O. (hereinafter the “SERVICES”).

These Terms and Conditions of Use (hereinafter the “TERMS”) define the conditions under which USERS (individuals aged at least 18 years, with legal capacity, and registered on the SITE) and VISITORS (individuals accessing the SITE without registration) may access and use the SERVICE.

Access to, use of, and/or registration on the SITE implies full and unconditional acceptance of and compliance with all provisions of these TERMS, which therefore constitute a contract between A.S.O. and the USER/VISITOR. If the USER/VISITOR does not wish to accept all or part of these TERMS, they must refrain from using the SITE.

The USER/VISITOR is expressly informed that the only binding version of the TERMS is the one available online on the SITE. A.S.O. reserves the right to modify them at any time, in particular to reflect legal, jurisprudential, editorial, and/or technical developments. Therefore, the USER/VISITOR is advised to always refer to the latest version of the TERMS each time they access the SITE. However, no modification of the TERMS shall be enforceable against the USER/VISITOR if it contradicts the TERMS in force at the time of the acquisition of the SERVICE offered on the SITE.

ARTICLE 3 – PRESENTATION AND REGISTRATION ON THE SITE

3.1. Presentation

The SITE contains information, photos, and videos and allows the purchase of SERVICES.

The SITE is freely accessible to any VISITOR with an internet connection. However, access to certain sections and features of the SITE, as well as the purchase of SERVICES, is reserved for USERS after identification using their username and password.

All costs associated with access to the SITE are the sole responsibility of the USER/VISITOR, who is also solely responsible for the proper functioning of their computer equipment and their internet access.

The SITE is accessible at all times except in the case of interruptions for maintenance purposes and/or in cases of force majeure (technical problems, network failure, etc.).

3.2. USER Registration

To access restricted sections and features and to purchase a SERVICE, the VISITOR must create an account for its agency (company, travel agency, charity…). They must complete an online form providing their personal data necessary for account access, service management, and the selected payment method. All mandatory fields must be completed correctly; otherwise, registration will not be validated.

The USER undertakes to provide accurate and up-to-date information. In particular, they agree not to create a false identity likely to mislead A.S.O. A.S.O. reserves the right to immediately suspend or terminate the account of any USER in violation of these TERMS and, where applicable, deny them access to all or part of the SITE.

A USER may not hold more than one account under any circumstances; A.S.O. reserves the right to delete all duplicate accounts if necessary.

Once their account has been validated, the USER may at any time modify or update the information provided. The USER is solely responsible for their account, username, and password. A.S.O. cannot be held liable for any use of the USER’s account by a third party.

ARTICLE 4 – TERMINATION / CANCELLATION

4.1. At A.S.O.’s initiative

A.S.O. may, by operation of law, terminate the account of any USER whose behavior is contrary to any of the provisions of these TERMS.

4.2. At the USER’s initiative

The USER may close their account at any time by filling out the “Contact Us” form available on the SITE, provided that no SERVICE is currently active on their account.

ARTICLE 5 - OPERATION OF THE SERVICE

5.1. Content published by A.S.O.

By connecting to the SITE, every VISITOR/USER will have access, according to their status, to the content published by A.S.O.

The content published by A.S.O. remains its exclusive property under the terms and conditions set forth in Article 9 entitled “Intellectual Property” of these Terms and Conditions of Use.

5.2. Content shared by the User

The USER is solely responsible, towards A.S.O. and third parties, for any damage, direct or indirect, of any kind whatsoever, caused by content or any other element they communicate, transmit, or distribute, as well as for any violation of these Terms and Conditions of Use.

Users are reminded that they must comply with all applicable laws and regulations as well as the rights of individuals.

A.S.O. reminds the USER that the Internet network cannot guarantee confidentiality. Consequently, any communication by the USER of sensitive or confidential information such as, but not limited to, bank card numbers, confidential codes, addresses, phone numbers, emails, or passwords, will be made under their sole and entire responsibility.

ARTICLE 6 - ADVERTISERS / PARTNERS

The USER/VISITOR is solely responsible for any correspondence and/or commercial relationship (including participation in promotions, delivery, and use of goods or services) with any advertiser present on the SITE.

A.S.O. shall in no case be held liable for any loss and/or damage of any nature whatsoever arising from such correspondence or commercial relationship with said advertisers.

ARTICLE 7 - THIRD-PARTY SITES – HYPERLINKS

The web pages of the SITE may contain hyperlinks redirecting to websites published by third parties (hereinafter “THIRD-PARTY SITES”) over which A.S.O. has no control.

If the USER/VISITOR decides to access these sites, they do so at their own sole risk.

A.S.O. assumes no responsibility for the content of THIRD-PARTY SITES or the content to which these THIRD-PARTY SITES may refer. The presence of hyperlinks to THIRD-PARTY SITES shall not imply that A.S.O. in any way endorses the content of such sites.

A.S.O. is not responsible for any modification or update concerning THIRD-PARTY SITES. A.S.O. is not responsible for the transmission of information from THIRD-PARTY SITES or their malfunction. These links to THIRD-PARTY SITES are provided to USERS/VISITORS solely for their convenience.

USERS/VISITORS are solely responsible for any transaction made with third parties, including advertisers appearing on the SITE, including but not limited to delivery operations and payment of goods and services.

The USER has a limited, revocable, and non-exclusive right to link to the SITE’s home page solely for private, non-commercial purposes. Any website that includes a link to the SITE (i) must not misrepresent its relationship or claim that such a link has been authorized, nor include trademarks, names, trade names, logos, or other distinctive signs related to or belonging to A.S.O. and/or its events; (ii) may not include content that could be considered distasteful, obscene, offensive, controversial, inciting violence or discrimination based on gender, race, or religion, contrary to public order, or illegal; (iii) may not link to any page of the SITE other than the homepage; (iv) must link to the address of the SITE itself, without allowing the linking site to reproduce the SITE or create a “frame” around any of its pages. A.S.O. reserves the right to request, at any time, the immediate removal of any link to the SITE.

A.S.O. has no control over the information, content, products, or services provided by other websites that may have established links to the SITE.

ARTICLE 8 - COMMUNICATION BETWEEN THE SITE AND ITS USERS

A.S.O. will primarily communicate with USERS via email, SMS, or messages posted on the SITE, after obtaining their consent.

The USER may also choose to receive information and offers from A.S.O.’s partners via email and/or SMS, provided that they have given their consent.

ARTICLE 9. CONFIDENTIALITY AND DATA PROCESSING

Where it is necessary to provide personal data in order to access certain content or services on the SITE, the USER undertakes to ensure that such data is truthful, accurate, authentic, and valid. A.S.O. will process this data by automated means in accordance with its nature and intended purpose, as set out in the page dedicated to the Privacy Policy.

ARTICLE 10 - INTELLECTUAL PROPERTY

A.S.O. is the exclusive owner or licensee of all intellectual property rights relating to the SITE and all of its content (both substance and form), worldwide: logos, graphic charter, site layout, texts, section titles, pages, scripts, icons, pictograms, photographs, videos, data, statistics, and any other editorial content.

The USER/VISITOR is prohibited from reproducing and/or using the trademarks, logos, and domain names appearing on the SITE.

No element of the SITE (texts, articles, photos, drawings, images, videos, data, statistics, etc.) may be copied, reproduced, modified, republished, uploaded, altered, transmitted, or distributed in any way or form, whether partial or complete, without the prior written authorization of A.S.O., except for strict use for press purposes and subject to compliance with intellectual property rights and any other property rights mentioned.

Any full or partial representation of the SITE by any means whatsoever without A.S.O.’s express authorization is prohibited and constitutes an infringement that may incur the civil and criminal liability of its author.

A.S.O. therefore reserves the right to take legal action against any infringement of its intellectual property rights.

Any reproduction of content is, in principle, strictly prohibited without the express consent of its author.

Likewise, it is strictly prohibited to remove, circumvent, bypass, or manipulate any copyright notices, technical protection measures, or any information mechanisms contained within the SITE’s content.

The USER undertakes to respect all the aforementioned rights and to refrain from any action that may infringe them. In this respect, A.S.O. reserves the right to exercise any appropriate legal action or remedy to safeguard its intellectual and industrial property rights.

Where access to certain services requires the use of a password, the USER undertakes to keep it confidential and to use it personally and diligently. The USER is responsible for safeguarding such credentials and must not disclose them to any third party, whether temporarily or permanently.

The USER agrees to immediately notify the editor of the SITE of any unauthorized use of their password, including but not limited to loss, theft, or unauthorized access. Failing such notification, A.S.O. shall not be held liable for any consequences arising from unauthorized use.

In the event of a breach of these Terms and Conditions of Use, the USER may be held liable for any damage caused to A.S.O. or to third parties.

In the event of damage resulting from any unlawful, fraudulent, or improper use of the services, A.S.O. reserves the right to seek full compensation from the USER for any loss suffered.

The USER agrees to indemnify and hold A.S.O. harmless from and against any claims, actions, or demands brought by third parties arising out of or in connection with the USER’s access to or use of the SITE.

The USER further agrees to indemnify A.S.O. for any damage arising from the use of automated tools such as bots, spiders, crawlers, or similar data extraction methods, as well as from any conduct that imposes an unreasonable or disproportionate burden on the operation of the SITE.

ARTICLE 12 - LIMITATION OF LIABILITY

To the fullest extent permitted by law, you expressly acknowledge and agree that neither A.S.O. nor its affiliates, shareholders, licensors, suppliers, advertisers or sponsors, nor their respective directors, officers, employees, advisors, agents or other representatives, shall be or can be held liable to you or any third party for any indirect damages (including, without limitation, damages relating to loss of business, loss of data or loss of profits) arising in any way from the SITE and/or the materials it contains, from any linked site or from any product or service purchased through it, or relating thereto.
